What is workers’ compensation?

Workers’ compensation is a benefits system established under California law and includes the vast majority of businesses and other employers across the state. The program is intended to ensure that workers who are injured on the job obtain access for medical treatment and temporary disability payments when a person is unable to work. Mileage reimbursement for doctor’s visits is another benefit that falls under medical treatment. Another benefit that falls under medical treatment is mileage reimbursement for doctor visits. In some cases, death benefits for family members may be available in the tragic event that an employee is killed at work.

What steps should I take if I am injured at work?

If it is an emergency, call 911, seek medical treatment immediately, and tell emergency responders that the injury is job-related. 

Anyone injured or who develops a medical condition on the job should also promptly inform his or her employer of the situation. Report the injury or illness as soon as you have reason to believe that it is job-related. State law generally requires injured workers to report the injury to their employers within 30 days and within one year of the accident to file a claim. Doing so immediately can help avoid lags in medical treatment and benefits payments.

It is also essential to document the situation. Jotting down notes on how the injury happened, who you spoke with, text messages or emails that were exchanged, and how your employer responded can help build a successful claim.

What types of benefits are offered?

Workers’ compensation benefits are designed to compensate injured employees for the financial consequences of an injury or illness. The four main benefits are temporary disability, permanent disability, medical treatment, and the Supplemental Job Displacement Voucher. What if I'm undocumented? Am I able to file a workers' compensation claim?

Yes. Undocumented workers are eligible to receive workers’ compensation benefits in California. However, undocumented workers’ status can raise complicated questions about whether they can be offered modified jobs while recovering from injuries. Therefore, it is crucial to consult an experienced California workers’ compensation attorney.

How do I pay a lawyer if I hire one?

The good news is that you typically do not need to pay your lawyer until after you obtain benefits. Legal fees are a percentage of the overall benefits payment which are paid when approved by a Workers’ Compensation Judge. The percentage is deducted from the total amount of the benefits in most cases. However, in certain situations, your employer may be liable to pick up the tab for reimbursement of medical expenses paid out of pocket, such as pharmacy prescriptions, modifications made to the home, and home health care services.
